All of Instella-MoE's model weights are released under the ResearchRAIL license, which restricts use to academic and research purposes only. This is not a free license — it prohibits commercial use and restricts users' freedom to use the model.

In addition, Instella-MoE's pretraining used 7.1 trillion tokens from a data mixture. If that mixture contains any non-free-licensed data sources (such as CC-BY-NC), then even if the model weights were free (they are not), the application as a whole would still be non-free under the FSF's criteria.

Saying "fully open" in description isn't just to free software users.

Either you remove those statements or make it truly fully open.

Otherwise it is deception.
